Terms of Service



NOTE:



1. Introduction

1.0 This Acceptable Use Policy ("AUP") is an agreement between Canetx.net (in conjuction with Canetx (iNORTH INC.) and the person(s), business, organization and/or community using services provided by Canetx.com.

1.1 This Acceptable Use Policy determines your rights as an account holder at canetx.com

1.2 This Acceptable Use Policy will also determine what rights canetx.com has over an account(s).

1.3 The Customer is NOT be allowed to claim damages from canetx.com based on downtime due to acts of god, facility problems, hardware failure, attacks, or malicious acts.

1.4 canetx.com has the right to suspend and/or terminate customers account(s) if an inconsistant large amount of traffic is seen directed towards a customers account, ip, or site in any way.

1.5 The customer is responsible to make sure they don't have any illegal files, such as: warez ( this includes pirated movies, games, music(MP3) ), in their home directory. If found, Canetx.com has the right to suspend and/or terminate the account without a refund at any time

1.6 if canetx.com suffers unexpected downtime due to unexpected outages there will be a credit of days affected applied to the customer's account(s) but no Refunds will be subjected.

1.7 if any user is involved in anyway with abuse, attacks, or DDoS nets, the users account can and will be terminated without refund.

1.8 The customer in contract MUST be at least 18 years of age by law, or have the consent of a parent or legal guardian.

1.9 Accounts purchased through fraud will be closed without warning and information forwarded to the respective authorities.

1.10 canetx.com is NOT responsible for ANY content found within a users account(s), and will NOT be liable for any damages caused by information, files, or content on an account. Abuse is not tolerated and if informed of abuse an investigation will determine whether a suspension and/or termination is in order.


2. Responsibilities and liabilities of canetx.com Canada

2.1 canetx.com will attempt to maintain a stable and useable system and infrastructure for all users.

2.2 canetx.com will extend account terms to compensate for unscheduled outages. However, canetx.com will not provide refunds for any unexpected outages out of our control.

2.3 canetx.com will always attempt to accommodate users needs within reason and our ability.

2.4 canetx.com is not responsible of damage caused to the customer directly by actions of canetx.com. In no event shall canetx.com aggregate liability exceed the amount paid by the customer to canetx.com for services. Incidents outside the server maintained by canetx.com are beyond our responsibility. canetx.com does not compensate unexpected or indirect damages.

2.5 canetx.com has the right to change the way it provides service to the customer. Such changes will be declared one (1) month in advance.

2.6 canetx.com has the right to change the customer's login, email and any information within it's network, in case it is in conflict with the system configuration.

2.7 canetx.com may change the pricing of its services at any time but will inform customers at least 3 months prior to any billing increase.


3. Responsibilities and liabilities of the customer

3.1 The customer is responsible of seeing that applications run from his account are of no disturbance to other users of the system or network. The customer is also responsible for function ability or costs of his own applications. Your own applications are all applications not installed by canetx.com Canada.

3.2 The customer is responsible for his actions on the network and servers found within the network, where he is responsible for causing any damage, breaking copyright, storing illegal content, or affecting others in a negative way.

3.3 The customer is responsible for his account information and is committed to keep this information to himself, and not giving it to any third party. The customer is responsible of actions done by using his account and of possible expenses caused by his account in the network.

3.4 In case the customer breaks this contract by his actions, he is hereby responsible of compensating the damages caused to canetx.com or possible third party. canetx.com can also suspend and/or terminate the contract without refund.

3.5 Since the billing and contacting is mainly done by email, the customer is responsible of informing canetx.com of his current working email address. canetx.com is not responsible in case the customer does not read email sent to an address he has given to us.

3.6 A customer is aware of the specific account and its features before purchase. canetx.com Offers a wide range of services, each with specific features. If a customer wishes to aquire features not found within their specific account limits, a charge to upgrade to those features will be applied.


4. Billing

4.1 The customer pays of services according to current prices set by canetx.com. Billing period is one (1) month, three (3) months, six(6) or twelve (12) months, depending on the type of contract between canetx.com and the customer. Payment will be done in advance.

4.2 Unless payment has been done by the day it is due, canetx.com has the right to suspend the customer's account untill payment is recieved in full.

4.3 canetx.com has right to change the prices of it's services. Customers will be informed of changes at least one (3) months in advance. Changes caused by law or taxes are immediate.

4.4 canetx.com has right to change the prices for an individual customer or terminate his account, in case bandwidth usage caused by this customer exceeds the limitations set by our listed packages. Bandwidth exceeding a package limitations will be billed by $25 per GB over quota.

4.5 canetx.com will Voice Verify every single transaction within the United States, Canada, and the United Kingdom. All payments from other countries will be forced to Email / Fax a credit card statement and a Photo ID.

4.6 Fraudulant payments recieved will result in immediate termination of an account and all files within will be deleted.

5. Validity

5.1 Contract is valid with a one (1) week cancellation time, unless other way has been decided. Both sides of the contract have the right to cancel the contract, in case the other side does not obey terms set in the contract.

5.2 canetx.com has right to cancel the contract immediately in case the customer, by his actions, causes damage to the network or to a third party. Illegal usage of the services gives canetx.com the right to cancel the contract and delete any content.

5.3 canetx.com has right to move this contract to a third party. However, canetx.com is responsible to inform the customer of such an event.

5.4 The customer has no right to move this contract to a third party.

5.5 canetx.com retains the right to change terms of the contract or prices of it's services.

5.7 canetx.com has the right to not revalidate the contract, in case the customer has received one or more warnings of his actions violating the terms of service.


6. Abuse

6.1 canetx.com reserves the right to terminate anyone who is found to have abused his or her account; Without warning in extreme cases.

6.2 Any user exceeding his allotted number of background processes will find the most recent processes killed automatically.

6.3 All users will be permitted two (2) connections per background process

6.4 In the event that canetx.com notices a user is performing illegal actions, canetx.com will immediately and without warning to the user notify law enforcement officials. canetx.com will attempt to accommodate any investigations requested by law enforcement officials within reason and based upon the laws of the province of Ontario.

6.5 Users who feel these abuse policies are unreasonable should consult with an administrator before purchasing an account. No accommodations will be made after an account has been established.

6.6 canetx.com reserves the right to blacklist (disallow) any software or content for any reason. Any account found participating or associating with any blacklisted content or service may be terminated without refund.

6.7 The customer takes responsabilities in all of their actions. canetx.com reserves the right to terminate that customers account with no credit or refund.


7. Disputes

7.1 Disputes may be discussed with canetx.com, in hopes of reaching a mutual agreement.

7.2 For any reason service may be cancelled and a prorated refund issued. Refunds will be issued in the form of CHECK to the address given during order, or a verified credit card/paypal address.
